A federal court convicted Lawrence Sacks of Rolling Hills, Monday, Jan. 25, with 16 federal charges for billing patients and their insurance companies surgical procedures such as facelifts and tummy tucks.

Sacks, a physician who operated Madison Park Cosmetic Surgery and Laser Center with offices in San Pedro and Torrance, was found guilty of defrauding insurance companies by billing them with “medically necessary” surgeries that were cosmetic. The verdict was handed during his second trial. The jury deadlocked, 11-1, during his first trial in November in favor of guilt.

After four hours of deliberation, a jury found Saks guilty of four counts of health fraud, five counts of mail fraud, four counts of false statement relating to health care and three counts of aggravated identity theft for using doctors’ names used to submit insurance claims.

The FBI and the IRS conducted the criminal investigation.

Court evidence showed that Saks collected patient payments for elective procedures then filed insurance claims for surgeries such as tumor removals and hernia repairs. He collected about $6,000 in payments after submitting about $87,000 in fraudulent claims to insurance companies.

However, these are just the latest in a series of legal troubles Saks has been facing recently. In April 2009, the Medical Board of California revoked his license. The Medical Board found that Saks committed "acts of gross negligence; repeated negligence, failed to maintain adequate and accurate medical records in the care and treatment of two patients; failed to maintain malpractice insurance; and failed to timely report a patient death."

The most serious charge pertains to the death of a 29-year-old woman who underwent surgery for liposuction at Saks' Torrance outpatient clinic, Madison Park Cosmetic Surgery and Laser Center, in March 2004. She later died at Torrance Memorial Medical Center. Saks acted as both the anesthesiologist and the surgeon, and the board found that he was at fault for not monitoring his patient properly during the procedure. Saks also did not notify the licensing agency of the woman's death within 15 days as required by law.

In 1990 he plead guilty to one count of tax evasion and one count of filing false federal income tax returns. The pleas followed a yearlong Internal Revenue Service investigation that found that between 1984 and 1987 Saks routinely cashed the checks of his patients rather than depositing them in his business bank account.

Sentencing on these latest charges is expected to take place March 29. Sacks face up to 166 years in prison. He also is scheduled for another trial March 8 on charges of defrauding disability insurance companies, after stating he was unable to work.
