Lawyers representing United Teachers Los Angeles filed a lawsuit against the Los Angeles Unified School District Monday, Dec. 21, arguing that LAUSD is not complying with the state’s educational codes.
Education Code Section 47605 (a) (2) requires that a public school charter be achieved only with a petition signed by 50 percent of the permanent status teachers at the school to be converted.
UTLA, a group of teachers and parents from Garfield High School who slated to move to the new Esteban Torres High School due to overcrowding other teachers from with similar issues joined the lawsuit against the district.
The lawsuit comes at the heals of the Public School Choice Resolution passed by the district in August, after which 24 new schools and 12 existing school became the focus of the 2010-11 school year process.
The union has been working with schools and communities to customize a plan to help reform the 36 schools.
“Public schools belong to the community,” said UTLA president A.J. Duffy in a statement released by the union. Especially at new school, it is important for parents, teachers and the community to se stability in the form of teachers who they know are committed to their school and community.”
The union also is exploring other legal avenues regarding the transfer rights of teachers to new schools and the use of school board funds for charter schools.
